Some Myths about Obama’s Decree Debunked

  • It does not apply to privately-funded schools and universities, only those receiving Title IX funding, although if the case is brought to the Supreme Court, as it most likely will be, there’s a very good chance that they will cite the Civil Rights Act of 1964 as a precedent and make discrimination against transgender individuals illegal. This is an important step toward victory, but it is only one step.
  • The decree does not violate the constitution as transgender individuals are being considered protected under sex (i.e. individuals whose biological sex as displayed on their birth certificate does not match their gender identity), although the suggestion that the decree offends “religious sensibilities” does violate the separation of church and state.
  • Donald Trump has responded and he does support the right of transgender people to use whatever bathroom they choose, although he believes it should be an issue of state’s rights.
